Does a spent conviction show on a police clearance

What are convictions spent on criminal records? Do you need to disclose spent convictions? What does a spent conviction mean? Can an employer refuse to disclose a conviction?


Some spent cautions and convictions are ‘ protected ’ and will not show on a DBS certificate.

The amount of time for rehabilitation depends on the sentence impose not on the offence. The more serious the conviction , the longer the period of rehabilitation. Spent findings are also not shown on a National Police Check record depending on what state they are in. Most spent convictions and cautions will still appear on standard or enhanced checks, and employers that do these checks can use what comes back on the check and take it into account when making a recruiting decision if they believe it’s relevant to the role. The certificate contains your complete conviction history , as recorded on police central records , including “ spent” and “ unspent” convictions.


A caution or conviction that is filtered from your DBS check is not removed from police records – it just means that if the job you’re applying for requires a DBS check, you’re legally entitled to withhold the details of any filtered caution or conviction. Spent convictions are not included on a basic disclosure. However, Some Records Will Never Clear Of course, there are some crimes that will never be filtered from records and will always appear when a DBS check is ordered. There are some spent convictions which will always appear on DBS Checks and if you have any concerns about this, it’s worth checking the previous link for a comprehensive list of these. The police retain details of convictions, cautions, final warnings and reprimands on the Police National Computer (PNC) until a person reaches 1years of age. This means that the conviction will no longer be disclosed on police or other criminal history checks.

Security clearance is completely different to a CRB check and comes under the Official Secrets Act. However, you would still have to declare it to the police when applying for a job, whether it is spent or not. The procedure for obtaining police certificates differs depending on the issuing country and is known by various names.


This is not the case. In essence, it is a document. The fact that a matter was finalised by way of ‘without conviction’ or ‘no conviction’ and thus becomes a Spent Conviction does not mean that it will never appear on your history. Such certificates are NOT acceptable for employment vetting.
