Hoa proxy abuse

That drew the following response from another HOAleader. A board member goes around collecting proxies in order to keep people on or off the board to his liking.


I was hoping another look at abuse using proxies would result I some additional words of wisdom. A proxy is a document. HOA board members can rig elections through several methods. HOAs have rules in place that allow individuals to vote. So, when does the HOA step over the line?


What follows is a look at what qualifies as HOA abuse. HOA members have a right to vote on certain association matters, including election of board members and adoption or amendment of covenants. Homeowners should receive a proxy in the mail along with information (called a proxy statement) describing the issues to be voted on.


Based on the information they have received in advance each homeowner has the opportunity to give their consent for someone. After several years observing the HOA abuse issue and working through lawsuits and lobbying, I am convinced that the most effective method to stop HOA abuse is a grassroots effort to reclaim your HOA for the neighborhood. Do not wait for an attorney, a judge, or the legislature to help you. To be vali a proxy must be dated.


Discriminate undiscriminatingly. A limited proxy is not secret. Q: I am an owner of a home in an HOA. Our driveway (paver blocks), which we had installed about seven years ago, has begun to sag and become wavy in many places. What should be of the most concern to any member of an HOA or Condo Association is if the proxy form states that the secretary or another officer will be the proxy holder. This gives too much power to those in office. When a limited proxy is sent to the members to mark how the proxy holder should vote, is this limited proxy a ballot? HOA fraud is a non-violent financial crime…but having to face criminal charges for it can nevertheless lead to steep penalties, not to mention terrible personal and professional repercussions.


One form of control by proxy is to engineer situations in which abuse is inflicted upon another person. Such carefully crafted scenarios of embarrassment and humiliation provoke social sanctions (condemnation, opprobrium, or even physical punishment) against the victim.
