Clean slate law nz

Apply to have a conviction disregarded You can apply to have convictions disregarded so that you do have a clean slate. It means that when an eligible person is asked about their criminal recor they can say they have no criminal record. When is the clean slate scheme available? The rationale behind the legislation was to enable people who had certain convictions to put their past behind them without the stigma of a permanent conviction.


It allows for a criminal record to be hidden from the public if the person is eligible.

This means that people employed or engaged in work that involves regular or overnight contact with children cannot rely on the clean slate scheme for the purposes of that engagement and they must disclose all of their criminal history. The Criminal Records ( Clean Slate ) Act comes in to force on Monday, allowing hundreds of thousands of New Zealanders with minor convictions to finally put past mistakes behind them. Never been sentenced to a custodial sentence including jail or corrective. Under the Clean Slate Act , people can have their criminal history hidden from employers if they have not reoffended within that timeframe.


However, some offences are excluded for eligibility, and it does not apply to people who have been in prison, corrective training or a borstal. This law has the effect of concealing criminal convictions if certain requirements are met. If the Clean Slate Act applies to you then you will not be required to disclose criminal convictions, for example when applying for a job.


The “clean slate” law will help you put your past behind you by giving you the right, in some circumstances, to withhold information about your convictions. To do so, you will have to meet a range of conditions to do with your conviction history.

I suggest you can either apply for a rehearing of the sentence, or get the Clean Slate Act letter and get the Police in New Zealand to confirm that this is your recor on Police letterhead. Then get this certified by the NZ Embassy. The clean - slate bill had a very personal impact on several other MPs.


Perhaps it is time to look at what responsibility media have to let people move on. The Clean Slate Act was one of New Zealand’s first “right to be forgotten” laws. The Criminal Records Act, otherwise known as the Clean Slate Act, currently allows people to conceal convictions dating back seven years or more – providing they aren’t serious offences and didn’t result in jail time. I have sympathy for Mr Knight, but not sure a law change is the answer. If a person’s convictions are covered by the Clean Slate Scheme, immigration officers cannot, under any circumstances, request or require that an individual disregard the effect of the Clean Slate Scheme when answering questions about his or her criminal recor or disregard the effect of the Clean Slate Scheme and disclose, or give consent to the disclosure of, his or her criminal record.
